The legislature responded by passing 2009 Wisconsin Act 100, which takes effect July 1, 2010.4The media labeled the law as taking a firm stance against drunk driving by enforcing harsher penalties.5 However, a deeper analysis reveals that the new law encourages jurisdictions to consider and determine if a well-monitored treatment program, combined with a period of supervision and a reduced jail sentence, will be a more effective means to deter recidivism.
