Attorney Avi Berk Discusses Overturned Dassey Conviction

The Netflix series Making a Murderer has generated much interest and discussion on social media and in the press. Recently, a federal magistrate issued a 91-page decision overturning the conviction of Brendan Dassey and finding that Dassey’s confession was illegally obtained in violation of his constitutional rights.  Attorney Avi Berk was interviewed about that ruling on local ABC and NBC television stations, WHBY radio, and was also interviewed by CBS national radio out of Los Angeles. For many years, Avi has served as a tv and radio legal analyst discussing various legal topics. He did daily on-air television commentary during the Steven Avery and Brendan Dassey trials.

When asked what he expected the prosecution to do in response to the magistrate’s ruling, Avi stated that the prosecution will most likely appeal the magistrate’s decision to the 7th Circuit Court of Appeals, rather than pursue a new trial. When asked to comment on the effect of the Netflix documentary on the federal magistrate’s decision, Avi stated that the documentary raised many of the issues addressed by the federal magistrate, but did not believe that a documentary and social media discussion about it had any influence on the magistrate’s ruling.
