Is It Really Right I Don’t Have to Pay Any Legal Fees Unless I Win– Are There Hidden Costs?

No, there are no hidden costs.  You don’t have to pay legal fees for unemployment legal services unless you win your unemployment benefits.  Please note, however, that before representation a check payment to our firm’s trust (holding) account is required.  If you win unemployment benefits, the money in trust will be paid to our firm as a legal fee.  If you lose, the trust will issue you a check returning your payment.

Why Do I Have to Make Payment to a Trust Account?

Unfortunately, some persons have retained our firm, won their unemployment benefits with our legal assistance, and not paid any legal fees as they had agreed to pay.  Because of this, we needed to move to an arrangement where money is held in a trust account in advance of the legal work (and hopefully winning the case).  If unemployment benefits are won, only then would the firm be paid legal fees, using the money held in trust.  If you lose, the trust will issue a check returning the money to you, and no legal fee will be owed.

Is Every Worker Eligible for These Legal Services?

Most Wisconsin workers who contact our firm for unemployment representation will be eligible for pay-if-you-win unemployment representation.  Our firm understands that most unemployment disputes are arguable, and each side (worker and employer) has some facts for and against them.   We help workers in most situations, including those where there are highly contested facts and risks.

However, our firm cannot assist everyone, and in certain limited situations we decline to represent workers.

Does Your Firm Represent Workers in All Areas of Wisconsin, or Just Those Near Your Offices’ Sites?

We represent unemployment claimants/workers anywhere in Wisconsin.  We do try to limit travel, and we may seek to arrange phone or video conferences with you, and phone hearings with the State, to make representation workable and efficient.  The State’s unemployment office is generally flexible with such arrangements, and on those occasions where unemployment hearings have been conducted by phone, our firm has been just as successful in representing workers.

What Is the Legal Fee Amount I’d Pay if I Won My Unemployment Benefits?

For many workers, the fee is $940, although the fee can vary.  If you contact our office, we can assess and tell you exactly what your fee would be if you decide to retain us and later win your unemployment benefits.

What Does the Fee Cover, and Is It Worth It?

What you “get” for the fee are (1) legal advice; (2) help preparing for the hearing, and the most important issues and evidence; and (3) an increased chance of winning.

Generally speaking, the more weeks of unemployment benefits you expect to be at issue, the more important it is that you win your hearing, and the more important it is you carefully prepare for the hearing, whether that means getting an attorney and/or taking other measures to prepare.
