Personal Injury & Constitutional Litigation
The attorneys at Peterson, Berk & Cross, S.C., have appeared on behalf of thousands of individuals injured and disabled as the result of others' negligence for over 25 years.
- Represented a severely injured individual in a products liability case against a national importer of fireworks from China. The case was tried to a conclusion versus multiple out-of-state lawyers brought in for trial by the defendants. The case resulted in a total award in excess of $1.9 million.
- Protected the fourth amendment constitutional rights of multiple individuals, ultimately forcing local law enforcement to alter their policies and establish guidelines to prevent wrongful armed searches of residential homes.
- Established a new claim in Wisconsin to allow a mother whose baby was stillborn as a result of medical negligence to recover for her distress.
- Represented 18 homeowners in claims against the City of DePere for sewer damage to their homes after the city negligently maintained the sewer system. All homeowners were able to settle their claim without a trial.
- Convinced a judge to overturn an improper ruling of suicide in the death of a young man. The case garnered national media attention, including coverage by Fox, HBO, ESPN and USA Today.
Family Law
- Practice divorce with dignity through collaborative divorce. Collaborative divorce is a cutting edge method to resolve disputes respectfully outside the courtroom through negotiation and mediation.
- Successfully protected the interests of grandparents to ensure they have a right to regular contact with their grandchildren after divorce proceedings.
- Experienced in representing individuals through the appellate process and in the Wisconsin Supreme Court.
- Represented unmarried individuals in the division of property and assets after periods of cohabitation.
- Represented countless individuals in pursuing unpaid child support payments.
- Argued before the Wisconsin Supreme Court on behalf of an adoptive mother in the first lesbian custody case to be decided in any state.
Criminal Law
- Approximately 60% of our criminal defense clients charged with felonies had the charges reduced or dismissed, resulting in no felony conviction.
- On appeal, freed a man from prison when the Court of Appeals agreed that the State had not presented enough evidence to show that the individual was a habitual criminal and the penalty enhancer had to be dismissed.
- Defended an individual arrested for drunk driving after he was found sleeping in his car with the ignition on outside a bar, resulting in a not guilty jury verdict.
- Represented an individual arrested for battery and disorderly conduct after his fiancé claimed he had attacked her, but the jury ultimately found that he had acted in self defense to her attack.
